Ruohs sold defendants 110.25 acres of land for $103,333.33, with down payment of $10,000, promissory note for $23,333.33, & remaining $70,000 in bonds to be issued by Whitney Mills. Ruohs retained sale contract but lost the deed of trust for $70,000 in bonds. Defendants refused to issue him a replacement copy. Ruohs sued to get to court to force them to issue him another copy.
