Gamble, Will A. McTeer, and A.S. Mason were partners in trade until Mason's death. A settlement was made which found the plaintiff indebted to the Mason estate for $500. Arch Mason had obtained judgment of $261.17 for Gamble and McTeer's joint note. Gamble wants Arch Mason restrained from collecting said judgment and for the amount of $72.23 be deducted from the judgment-an amount Gamble believed was due to him by Mason estate for the amount he paid as surety in another suit.
