In June 1906 defendant purchased a thrasher from plaintiff for sum of $662 for which he executed 5 promissory notes. Plaintiff now sues to recover $833.64 which includes interest & attorneys fees. Plaintiff has also learned that defendant owns land valued at $4000, and asks court to levy on it with a portion of the proceeds from the sale to be used to pay the debt. Roddy argues that thrasher did not perform to his expectations so he ceased to use it.
