Branner and Mitchell had borrowed from Evans $2100 in bank notes. Branner and Mitchell executed the note and divided the money in half. Branner could not use his notes and Mitchell converted his to Confederate notes. Branner was prepared to pay Evans who refused to take the money for fear he would be robbed. Branner held the notes for Evans until he was killed during war. Galbarith had obtained judgment of $2474.55 against Branner from which he wanted relief.
