Carroll originally sued the railroads for $20,000, charging them with negligence in Hinton's death. Hinton, an employee of the Nash- ville & Chattanooga RR Co., was killed on 17 Aug. 1868, when the hand car he was riding on was struck by a train managed & controlled by one of the defts.
