Previous case states Fleming purchased a 1st class ticket on a train car owned by the company and on their property for her child and herself. She was shown into a car occupied by men and asked to be in a "ladies only" car, but was denied admittance and chose to ride on the platform until she gave in to ride in the men's car. Evidence dictates that the conductor would have protected her if she was a white woman. Sued for damages.
