Plntff. sued the deft. for $20,000, charging it with "willful negligence" in failing to keep the city's streets in good repair & free from obstructions. Plntff. alleged that on 22 July 1889 he was violently thrown from the wagon in which he was riding when it struck another, unattended, wagon that had simply been left in the street. The fall injured his leg so badly that it required amputation above the knee. Edgman's physician testified that he had heard plntff. say that his horse had kicked him.
