The Chancery Court of Grainger Co. agrees that the land claimed by the plaintiff Smith is the same property that once belonged to Alfred Livingston who died in 1863 during the War, leaving a widow, Jane, and 2 minor children, Edward & Mary E. Livingston. Mary E. Livingston married a King. Edward Livingston, now an adult, conveyed his interest in the land to Smith. Title to the land was vested in Livingston's heirs by 1878 Supreme Court Case Livingston v. Noe.
