Sam Smith, the brother of James Smith, sued the railroad company for the wrongful death of his brother for $2,999.99 damages. James was driving a school bus he had picked up from Mitchell Phillips to drive high school students to school. A train hit his bus while crossing the tracks, killing him instantly.
