Stuart, Marshall (incumbent) & Hugh A. Lane ran for county sheriff; Marshall narrowly won. Lane contested the election on grounds of fraud; Stuart was not involved in Lane's suit against Marshall. Later, Lane & Marshall admitted to election fraud, so Stuart brought a suit averring that the public interest had been aggrieved.
