Stuart, Marshall (incumbent) & Hugh A. Lane ran for county sheriff; Marshall narrowly won. Lane contested the election on grounds of fraud; Stuart was not involved in Lane's suit against Marshall. Later, Lane & Marshall admitted to election fraud, so Stuart brought a suit averring that the public interest had been aggrieved. Voting irregularities included persons being able to vote 2x-3x for Marshall, and Lane votes being counted as Marshall votes. 900+ illegal votes alleged.
