Martin, was sick at the time &, before he left to search for his dad's cow, asked him "to take his dog and pistol, and kill her a squirrel." James said it was his habit to hunt with the pistol. Issue was intent, as it's only a crime if def. had intent to go armed. James obtained a new trial because Circuit judge improperly charged jury that "it is no excuse if a pistol is carried solely for squirrel hunting."
