On 1 Sept. 1856 the defendant purchased a gelding from William Baldwin, promising to pay $300 for it when the horse was worth only $150. The $300 would be payable when the state of TN cast her vote for James Buchanan for President of the US on 4 Nov. 1856. The court judged this a violation of state laws against betting on elections.
