Jane sued Gleason and McBride, partners in trade in NYC under the firm name W.F. Gleason & Co. Jane and his father, Wyatt, had bought tract of land commonly known as the Cove Creek ore bank. Jane made verbal contract with his father and sold his tract for $36 and authorized him to sell it. Suit over the succeeding complex title dispute between the parties. Jane wanted plaintiffs restrained from entering land or exercising ownership over it and the Warranty Deed declared and void.
