Plntff. filed a $20,000 damage suit on behalf of Guinn's widow. Guinn, an employee of the railroad, was killed in a train wreck in Calhoun Co., AL in Dec. 1889. He was in a caboose that was sitting on the railroad tracks. Instead of taking action to stop the train as required by law its operators negligently ran into the caboose, killing Guinn. Plntff. sued under the laws of the state of Alabama.
