Plaintiff is the administrator of the estate of Thalmas Miller (dec'd), who was employed by the defendant as a crusher in the quarry. He was helping load stones onto cars to be crushed as they were pulled up by a cable. The cables were in poor condition and one broke, sending the loaded cart off the track and struck the deceased, crushing him and causing fatal injuries. Plaintiff states the defendant should have known about the weak cables and sued for damages in the sum of $25,000.
