Love Billingsley Gibson died in 1924, bequeathing a tract of land to Virgil Gibson and defendants W.H. and Olen Gibson. Virgil made a deed conveying his interest in said land to defendants in exchange for an old automobile and a $100 note. Kivett charged defendants with fraud-knowing that Virgil did not have the mental capacity to sell said land, that the land was worth $3000 and the consideration price he was to receive was inadequate.
