Plaintiff in error was accused of burning the barn of C. M. Whittemore located in the 7th Civil District of Davidson County. Whittemore testified that he awoke to find plaintiff lighting matches near his cellar. Plaintiff and his wife lived on Whittemore's property for several years and his wife cooked for Whittemore. At the time of the fire the plaintiff's wife still lived on the Whittemore farm but the plaintiff lived separately in "Black Bottom," in South Nashville.
