The Unicoi Funeral Home of Erwin, Tennessee executed to the plaintiff in error, a chattel mortgage to secure the payment of a note in the sum of $500. The note was not paid and the plaintiff institute replevin proceedings and gained control of a large stock of inventory. At the same time, the Unicoi Funeral Home was also indebted to the defendant who later brought suit against the plaintiff, alleging she was indebted to him by violation of the Bulk Sales law. |

The plaintiff was riding in the bed of a truck owned and operated by an agent of the defendant, when a low hanging telephone wire caught the plaintiff on the back of the neck and threw him from the truck. He sustained serious and permanent injuries and the plaintiff alleges that the defendant should have known that their wire was in disrepair. Suing for damages in the sum of $2,999.00. |

Thomas owned lot on North Main St. in Erwin, TN on which he erected 1-story river rock bungalow as his residence. Dispute arose w/Town of Erwin when ditch running on side of Thomas' lot overflowed & flooded his basement, which Thomas claimed resulted from Town's actions in regrading nearby Elm & Maple Streets. Jury ruled in Thomas' favor, awarding him $650. Witnesses: Roy Morris, George Oakley, G.K. Painter & wife (all neighbors), O.E. Bogart, A.R. Plaintiff later developed acute pulmonary tuberculosis, became totally disabled, permanently unable to perform any work. Insurance company failed to uphold their contractual agreement. Plntff. widow & admr. of of Dr. Ernest B. Bowery, who died on 7 April 1931 of injuries suffered in an automobile accident. On 5 Aug. 1930 Dr. Bowery took out a $10,000 life insurance policy with Southern States Life Insurance Co. which was later taken over by the deft. which has refused to pay the plntff.'s claim. Plntff. filing suit for $10,000 plus interest & penalties. Deft. argues it has no liability as Dr. Bowery died by his own hand. It is suggested that he was heavily in debt. 2 Folders. |

In addition, a right of way to a spring on the def. land was included in deal. The plaintiff built fences and dug ditches to improve the land. Plaintiff sued when defendant rescinded the agreement. |

Helms originally indicted for criminal libel. On 31 July 1934 he circulated a "printed pamphlet" in which he stated that J. M. Gouge was an ex-thief. According to the allegations Gouge & a Dock Davis were the heads of a gang of thieves who operated in Mitchell Co., NC. Gouge a Justice of the Peace & magistrate. At one time Gouge & Helms ran against one another for the office of magistrate, with Gouge the victor. |
