Isaac and Lewis Guthman prosecuted an injunction bill against Henderson, D.C. McMillin, and Isaac Low. Isaac Guthman had purchased town lot belonging to Henderson from Master of Chancery Court for $1315. Plaintiffs executed 2 notes. Henderson demanded payment in gold or silver, which plaintiffs did not have. One note was not paid and judgment was taken on it in court in favor of McMillin and was in hands of Low, sheriff, who levied it on Lewis Guthman's property. Injunction bill to stop execution. |

Add. Defs: Jeptha Osborne; Thomas Ballard, admr of Washington Ballard, dec; John Stanfield. Edwards bought land from Porter, paying cash & note for the balance. Porter owed money to Robert Boyd & to Ocoee Bank. Boyd sued to set aside Porter's land sale. Porter assigned Edwards' note to def Osborne, who assigned it to Stanfield. Edwards says both assignments done fraudulently to prevent attachment of the note. Since he no longer has land he bought from Porter, Edwards seeks relief from note enforcement. |

Blair & pla. as securities for $2,228.13. pla. says Ford as principal should have his property exhausted first. Ford owned 8 slaves, livestock & prop. subj to execution, but may not garner what worth during the 'troubles of the country'. Ford demands gold or silver, almost impossible to obtain. pla. sought injunction against levy of his property. |
