Plaintiffs & defendant had entered a partnership in which Arrow Transfer would take over distribution of Atlas Beer & plaintiffs would withdraw after being paid $2000 by deft. Deft. paid first $1000, but not the additional monies, saying plaintiffs had no franchise rights to sell although Atlas Beer had approved the agreement. |

Plaintiff is sued for damages and debt in the sum of $2,000 for a breach of contract by the defendant. In 1934, the plaintiff entered into an oral contract with E. H. Newberry for the purchase of a lot and erected a house, insured by the defendant for $1,500. The defendant procured a rider for the policy, E. H. Newberry, by F. L. Cox, defendant's agent, without the plaintiff's knowledge or permission. Later, the house and contents were destroyed by a fire, and the defendant gave benefits to Newberry. |

Plaintiff sued to recover $1650 in lost payments, plus interest. Until Feb. 1930 he received $50 per month from his insurance because of a disabling gunshot wound to his shoulder, suffered 5 Dec. 1928. His insurance premiums were also waived. In Feb. 1930 deft. discontinued the payments & declined to further waive the premiums on grounds that plaintiff was no longer disabled as defined by the terms of his policies. Hackworth argues that he is capable of small tasks only & is still disabled. See ET1553 |

Plaintiff engaged the defendant to investigate his property lines & insure his title. Also took out $1500 policy with company to insure against failure of title. After assurances that everything was in order plaintiff began work on his building, only to be sued by L. W. Lynch, who claimed that the building extended 18 inches onto his property. Plaintiff lost the suit & was unable to complete his building. He sued defendant to collect the $1500 plus penalties provided by law. |
